These terms are an agreement between you and [LEGAL ENTITY NAME NOT SET] ("Voushify", "we", "us"). They govern your use of voushify.com and the Voushify application. By creating an account or using the service, you accept them. If you do not accept them, do not use Voushify.
Section 17 contains a binding arbitration agreement and a waiver of your right to participate in a class action. It affects how disputes between us are resolved. Please read it.
1. The words we use
- A Voush is a recommendation written about one person by another.
- A Voushee is the person a Voush is about, and who asked for it.
- A Vousher is the person who writes it.
- A Viewer is a signed-in third party allowed to read it.
- Your Voush Score is a number calculated from the Voushes you have received and chosen to keep.
2. What Voushify is — and what it is not
Voushify helps people collect verified recommendations and show them to someone who is deciding about them. It is decision support, not a hiring authority.
We do not make hiring decisions, we do not recommend that anyone be hired or not hired, and a Voush Score is not a judgement about a person's worth. Anyone using Voushify to inform a decision about another person is responsible for that decision and for complying with the laws that govern it, including employment and anti-discrimination law.
Voushify is not a consumer reporting agency, and the service is not a consumer report as defined by the Fair Credit Reporting Act. You may not use Voushify as a factor in establishing eligibility for credit, insurance, housing, or any other purpose governed by the FCRA.
3. Your account
- You must be at least 16 years old.
- One account per person. Accounts are personal and may not be shared, sold or transferred.
- Use your real identity. Voushify depends on people being who they say they are.
- Keep your password secret and tell us promptly at trust@voushify.com if you think someone else has access to your account.
- You are responsible for what happens under your account.
4. Writing a Voush
Giving a Voush is free, always. The Vousher is never charged for writing one.
When you write a Voush, you confirm that:
- It is your own honest opinion, based on real experience of working with that person.
- You are not being paid or otherwise induced to write it.
- You agree to the audience the Voushee chose when they asked.
- You have not included anyone's private details, such as a phone number, home address or health information.
Who reads a Voush, and what they do with it. What you write, and anything you attach, can be read by the Voushee and by the people the audience rules allow, and they may rely on it and use it in their own decisions. You are responsible for what you include. We do not control how readers use a Voush and are not liable for that use. We ask you to confirm this each time you submit one.
You keep ownership of what you write. You grant us a non-exclusive, worldwide, royalty-free licence to store it, encrypt it, and show it to the people the audience rules allow — for as long as it remains on the platform.
On a paid plan (Pro or Premium), you may retract a Voush you wrote. Retraction removes it from the Voushee's record and from their Score. The right to retract is time-limited from submission, so that an endorsement cannot be used as leverage years later. That time limit runs from submission whatever plan you are on: upgrading after it has passed does not reopen it, and if your paid plan lapses you cannot retract until it is active again, but the time limit keeps running. Giving a Voush is free on every plan.
5. Receiving a Voush
- Voushes about you are part of your trust record.
- You choose the audience when you make the request. Widening it later needs the Vousher's approval, because the words are theirs.
- You can Hide a Voush on a paid plan. Hiding affects display only: the Voush stays in your Score and in the audit trail. Nothing you pay for moves your Voush Score. Paying to bury an honest recommendation would be reputation laundering, and we do not offer it. (A Vousher retracting a Voush they wrote is withdrawing their own words, not buying a change to your Score; see section 4.)
- You can Report a Voush that breaks our rules. Reporting is free on every plan and always will be. A Voush removed by moderation does leave your Score — that is a correction, not a purchase.
Valid but unflattering content is not a rule violation. You can hide it; we will not remove it.
6. Verification
Some features depend on verifying your identity, by email, phone, or government ID through a third-party provider. We may decline or revoke verification if we cannot confirm your identity. Verification is a statement about identity, not a guarantee about a person's character or ability.
7. Acceptable use
You may not:
- Write or solicit a false, paid-for, or traded Voush.
- Impersonate anyone, or create an account for someone else.
- Post unlawful, abusive, harassing, defamatory, or discriminatory content.
- Post someone's private or sensitive personal information.
- Scrape, crawl, or bulk-download other people's data.
- Probe, scan, or attempt to break our security or rate limits.
- Resell or redistribute Voushes or Scores.
- Use Voushify for any purpose governed by the Fair Credit Reporting Act.
We may remove content and suspend or close accounts that break these rules. Where we can, we will tell you why.
8. Copyright and the DMCA
If you believe something on Voushify infringes your copyright, send a notice to trust@voushify.com containing: your signature; identification of the work; identification of the material and where it is; your contact details; a statement that you believe in good faith the use is unauthorised; and a statement, under penalty of perjury, that your notice is accurate and you are authorised to act.
We will remove or disable material in response to a valid notice and tell the person who posted it, who may send a counter-notice. We close the accounts of repeat infringers.
9. Plans and payment
- Prices, caps, and what each plan includes are on our pricing page, which is public and needs no account. The plan and price shown there when you subscribe are the ones that apply to you.
- Subscriptions renew automatically for the same period until you cancel.
- Cancelling stops the next renewal. You keep paid access until the end of the period you already paid for — we do not cut you off mid-cycle.
- A lapsed or cancelled paid plan drops you to the free plan. It does not lock you out and it never deletes your received Voushes.
- One-off purchases are consumed when used and are not refundable once used.
- Payments are handled by Stripe. We never see your full card number.
- We may change prices with at least 30 days' notice before your next renewal.
- Taxes are added where applicable.
10. Refunds
If you were charged in error, or something did not work as described, email trust@voushify.com within 30 days and we will put it right. Beyond that, subscription fees already paid are not refundable, and we do not pro-rate a partial month or year.
11. Our intellectual property
Voushify's software, design, branding and the Voush Score methodology are ours. These terms give you permission to use the service — not a licence to our intellectual property. Do not copy, reverse engineer, or build a competing product from it.
12. Availability
We work to keep Voushify available but we do not promise uninterrupted service. We may change, suspend or withdraw features. Where a change materially reduces something you have paid for, we will tell you and offer a pro-rata refund of the unused period.
13. Ending the agreement
You may close your account at any time. We may suspend or close an account that breaks these terms, or where we are legally required to.
Closing your account does not delete Voushes you wrote about other people — those are part of someone else's record. Sections 11, 14, 15, 16, 17 and 18 survive termination.
14. Disclaimers
Voushify is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that any Voush is accurate. A Voush is one person's opinion. We verify identity where we say we do; we do not verify that a statement of opinion is true. You are responsible for how you use what you read here.
Some states do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
15. Limitation of liability
To the fullest extent permitted by law, neither we nor our suppliers are liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost opportunities, lost data, or loss of reputation, arising out of your use of Voushify.
Our total liability for any claim relating to Voushify is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars.
Some states do not allow limiting liability for certain damages, so parts of this section may not apply to you. Nothing here limits liability for fraud, or for anything that cannot lawfully be limited.
16. Indemnity
You agree to indemnify and hold us harmless from claims, losses and reasonable legal costs arising from your content, your use of Voushify, or your breach of these terms.
17. Disputes, arbitration, and class-action waiver
Please read this section carefully. It affects your legal rights.
Talk to us first. Most disputes are resolved quickly by email. Before starting formal proceedings, send a written description of the dispute and the outcome you want to trust@voushify.com, and give us 30 days to respond.
Arbitration. If we cannot resolve it, you and we agree that any dispute arising out of or relating to these terms or to Voushify will be resolved by binding individual arbitration administered by a recognised arbitration provider under its consumer rules, rather than in court. The arbitration will take place in [GOVERNING STATE NOT SET], or by video or telephone if you prefer, or in your home county if you ask. The arbitrator decides the dispute and may award the same individual relief a court could.
Class-action waiver. You and we each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of class proceeding. If this waiver is found unenforceable for a particular claim, that claim proceeds in court and the rest of this section still applies to every other claim.
Exceptions. Either of us may bring an individual claim in small-claims court, and either of us may seek an injunction in court to protect intellectual property or to stop unauthorised access to the service.
Your right to opt out. You may opt out of this arbitration agreement by emailing trust@voushify.com within 30 days of first accepting these terms, saying that you opt out and giving the email address on your account. Opting out costs you nothing and does not affect your use of Voushify.
18. Governing law
These terms are governed by the laws of the State of [GOVERNING STATE NOT SET] and the federal laws of the United States, without regard to conflict-of-law rules. Where a dispute is not subject to arbitration under section 17, the state and federal courts located in [GOVERNING STATE NOT SET] have exclusive jurisdiction, and you consent to that jurisdiction.
This does not remove any protection you have under the mandatory consumer law of the place you live.
19. Changes to these terms
We may update these terms. If a change is material we will tell you by email or in the application before it takes effect, and update the date at the top of this page. Continuing to use Voushify after a change means you accept it. If you do not, close your account.
20. General
- If any part of these terms is unenforceable, the rest stays in force.
- Not enforcing a term once does not waive it.
- You may not assign these terms. We may assign them to an acquirer of the business.
- These terms, with the Privacy Policy, are the whole agreement between us about Voushify.
- Nothing here creates a partnership, employment, or agency relationship.
